1. Acceptance of These Terms

By accessing or using corebalancewellness.com, scheduling a consultation, completing onboarding, or purchasing any wellness or telehealth service, you agree to these Terms, our Privacy Policy, and any supplemental policies posted on the website. If you do not agree, do not use the platform. Core Balance Wellness may update these Terms at any time. Updated Terms apply immediately unless required otherwise by law.
 

2. Eligibility

You must be at least 18 years old, live in a state where our services are available, provide truthful information during onboarding, and complete any required identity verification. We may deny access for safety, medical appropriateness, or noncompliance.

3. Nature of Services

Core Balance Wellness provides online wellness programs, access to independent licensed clinicians for medical evaluation, medication management for eligible patients, and digital tools, messaging, and educational resources. Core Balance Wellness itself does NOT provide medical care. Independent clinicians—licensed in your state—make all medical decisions, including diagnosis, treatment, and prescription of any GLP-1 medications. Participation does not guarantee medication approval.
 

4. Not Medical Advice

General information on the website is for education only and is not a medical diagnosis or treatment plan. Always follow your clinician’s instructions. If you experience a medical emergency, call 911 immediately.
 

5. Accounts & User Responsibilities

You agree to maintain accurate account details, keep your login secure, use the platform only for personal, lawful purposes, and not misuse messaging tools or upload harmful files. We may suspend or terminate accounts for violations.

6. Payments, Renewals, and No Refunds

You authorize Core Balance Wellness to charge the payment method on file for subscriptions, visits, or medication costs. All payments are final and non-refundable unless required by law. Clinician decisions (including declining to prescribe medication) do not entitle you to a refund.
 

7. Communications Consent

By providing your contact information, you consent to receive appointment reminders, updates on your treatment plan, support messages, and marketing communications (optional; can opt out). You can opt out at any time using “STOP” for SMS or the unsubscribe link for email.

8. Intellectual Property

All content on corebalancewellness.com—including text, branding, layouts, videos, and tools—is owned by Core Balance Wellness LLC and may not be copied, distributed, or modified without permission. Providers retain ownership of any professional content they create for care delivery.
 

9. No Warranty

The platform and services are provided “AS IS” and “AS AVAILABLE.” We do not guarantee uninterrupted access, compatibility with all devices, or outcomes from treatment.
 

10. Limitation of Liability

To the fullest extent permitted by law, Core Balance Wellness, its owners, contractors, and providers are not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim will not exceed $500. This limit applies even if we were advised of potential damages.
 

11. Telehealth-Specific Disclaimers

You understand and agree that telehealth has limitations, including inability to perform in-person physical examinations. Clinicians may determine telehealth is not appropriate for your condition. Prescriptions—including GLP-1 therapies—are issued only if medically appropriate, not guaranteed. Medication availability, compounding supply, and shipping timelines may vary. You must follow all instructions related to medication storage, use, and monitoring.
 

12. Independent Providers

Licensed clinicians who deliver telehealth services are independent contractors, not employees of Core Balance Wellness. Each clinician is responsible for their professional judgment, compliance with state laws, maintaining licensure, and malpractice coverage. Core Balance Wellness does not control clinical decisions.
 

13. Indemnification

You agree to indemnify and hold harmless Core Balance Wellness and its affiliates from claims arising from misuse of the platform, misrepresentation of your health history, failure to follow clinician instructions, violation of these Terms, improper use of medication, or use of rooted/jailbroken devices or harmful software.
 

14. Third-Party Services & Pharmacies

We may integrate or refer you to pharmacies, labs, payment processors, messaging vendors, or telehealth platforms. These third parties are responsible for their own services. Core Balance Wellness is not liable for delays, errors, or failures caused by them.

15. Modified or Incompatible Devices

You agree not to access our platform using modified operating systems (rooted/jailbroken devices). We are not responsible for security failures caused by altered devices.
 

16. Termination

We may terminate or suspend your access for policy violations, fraud or misuse, failure to maintain accurate information, or safety or medical risks. Upon termination, you remain responsible for all fees already paid.
 

17. Arbitration & Class Action Waiver

Any dispute will be resolved through binding arbitration rather than court. You waive the right to participate in class actions. This section survives account closure.
 

18. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
